NOTICE AT COLLECTION TO APPLICANT RESIDING IN CALIFORNIA

Impossible Foods Inc. and related entities (together, “Impossible Foods” or the “Company”) is aware of its obligations under the California Privacy Rights Act of 2020 (“CPRA”) and is committed to processing your data securely and transparently. This privacy notice sets out, in line with CPRA, the categories of data that we may collect on you as a candidate of the Company, the purposes for which the categories of Personal Information are used, the categories of third parties to whom the Personal Information is disclosed, and your rights regarding your Personal Information.

For purposes of this notice, “Personal Information” means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a natural person that the Company collects about its applicants, who reside in California, in their capacity as applicants for positions with the Company.

Personal Information Collection and Use

Why do we collect your Personal Information and how do we use it? What Personal Information do we collect and use? The categories of Personal Information and how we collect, use, or process about you may include the following.

Identifiers: Your personal details including your name, address, email address, phone number(s)

  • To evaluate applicants’ qualifications for employment with the Company.

  • To communicate with applicants.

  • For recordkeeping purposes.

  • To demonstrate applicants’ agreement to, or acceptance of, documents presented to them, e.g., confidentiality, invention assignment and arbitration agreement, acknowledgement of employment application, offer letter.

  • To evaluate and improve the recruiting process.

  • Professional or Employment-Related Information: evaluations, membership in professional organizations and professional certifications, work eligibility in order to comply with legal requirements, and current and past employment history

  • To evaluate applicants’ qualifications for employment with the Company.

  • To evaluate and improve the recruiting process.

  • For diversity and inclusion purposes.

  • For recordkeeping purposes.

  • Education Information: Non-public information such as academic transcripts, educational discipline records, and academic counseling records

  • To evaluate applicants’ qualifications for employment with the Company.

  • To evaluate and improve the recruiting process.

  • Characteristics of Protected Classifications Under California or Federal law: race, age, national origin, disability, sex, employment eligibility status, and veteran status.

    The Company may also collect the following characteristics (in addition to those listed above):

    (a) religion (includes dress and grooming practices and encompasses all aspects of religious belief, observance and practice); (b) sex (includes gender, pregnancy, childbirth, breastfeeding, or related medical conditions; also, sexual orientation); (c) disability; (d) gender identity; (e) gender expression; (f) marital status; (g) age, (h) familial status.

  • As necessary to comply with the reporting requirements of the federal Equal Employment Opportunity Act, the federal Office of Contracting Compliance Programs (if and when applicable), California’s Fair Employment and Housing Act, and for purposes of diversity analytics.

  • The Company may also use this Personal Information: (a) with respect to disability and/or medical condition, as necessary, to comply with Federal and California law related to accommodation; and (b) with respect to age, incidentally to the use of birth date for identity verification.

  • The Company collects this category of Personal Information on a purely voluntary basis, except where collection is required by law, and uses the information only in compliance with applicable laws and regulations.

  • Disability, familial status, marital status, and pregnancy, childbirth, breastfeeding, and related medical conditions as necessary to comply with Title VII, the Americans with Disabilities Act, and California law; religion and pregnancy, childbirth, breastfeeding, and related medical conditions as necessary to engage in the interactive process and provide reasonable accommodations under applicable law; national origin as necessary to comply with immigration laws.

  • Internet or Other Electronic Network Activity: Information about your use of the Company website, including Internet, browsing history, and other electronic network activity information.

  • To provide the portion of our website related to job openings and application submission

  • To understand how our website is used

  • To detect and prevent fraud

  • Sensitive Personal Information Collection and Use

    What Sensitive Personal Information do we collect and use? 

    The categories of sensitive Personal Information we may collect, use, or process about you may include the following:  

    Personal Information that reveals racial or ethnic origin, religious or philosophical beliefs or union membership

    Why do we collect your Sensitive Personal Information and how do we use it?

    We need to collect your Personal Information to:

  • As necessary to comply with the reporting requirements of the federal Equal Employment Opportunity Act, the federal Office of Contracting Compliance Programs (if and when applicable), California’s Fair Employment and Housing Act, and for purposes of diversity analytics.

  • The Company may also use this Personal Information: (a) with respect to disability and/or medical condition, as necessary, to comply with Federal and California law related to accommodation; and (b) with respect to age, incidentally to the use of birth date for identity verification.

    How we Collect Personal Information

    Impossible Foods collects Personal Information and sensitive Personal Information described in this notice directly from you when you apply for employment, or through third party vendors such as background screening providers. We may also collect certain internet and electronic network activity automatically as you use Impossible Foods systems.

    Other Collection and Uses 

    We may collect and use your Personal Information for other purposes not listed in this notice. If we do so, we will make it known to you at or before the time we collect, use or disclose your Personal Information and, if necessary,  obtain your consent.

    Disclosures of Personal Information; Categories of Third Parties to Whom Information is Disclosed

    We may disclose the Personal Information we collect to third parties to achieve the business purposes described in this notice. We disclose the Personal Information to the following categories of third parties:

  • Service providers who perform services on Impossible Foods’ behalf, such as helping manage the recruitment process and conducting background checks.

  • Impossible Foods’ affiliates.

  • To third parties, including law enforcement, as necessary to comply with Impossible Foods’ legal obligations or valid legal processes such as search warrants, subpoenas and court orders, to protect the rights and property of Impossible Foods, and during emergency situations to protect the vital interests of individuals.

  • If a business transfer or change in ownership transaction involving Impossible Foods occurs, in whole or in part, we will share personal information with the other parties in the transaction as necessary to complete the transaction. 

  • We may share your personal information with additional categories of third parties not listed in this notice. If we do so, we will make it known to you at the time we collect, use or disclose your Personal Information and, if necessary, obtain your consent.

  • CPRA Rights

    As a California resident, you have the following rights under the CPRA:

    Right to Know: You have the right to request that we disclose:

  • The specific pieces of Personal Information collected;

  • The categories of Personal Information collected;

  • The categories of sources from whom the Personal Information is collected;

  • The purpose for collecting, selling or sharing the Personal Information; 

  • The categories of third parties with whom we have disclosed the Personal Information;

  • The categories of Personal Information that we have sold or shared, and the categories of third parties to whom the Personal Information was sold or shared, by category or categories of Personal Information for each third party to whom the Personal Information was sold or shared;

  • The categories of Personal Information that we disclosed for a business purpose and the categories of persons to whom it was disclosed for a business purpose. 

  • Right to Delete: You have the right to request that we delete your Personal Information, subject to certain exceptions.

    Right to Correct Inaccurate Personal Information: You have the right to request that we correct inaccurate Personal Information we maintain about you, taking into account the nature of the Personal Information and the purposes of the processing of the Personal Information.

    Right to Opt-Out of Sale or Sharing: As stated above, we do not sell or share your Personal Information.

    Right to Limit the Use and Disclosure of Sensitive Personal Information for Certain Purposes: As stated above, we do not use or disclose your sensitive Personal Information for any purpose other than those permitted under the CPRA, including the purposes specified in this Notice.

    Freedom from Discrimination: You have the right not to receive discriminatory treatment for exercising your rights above, including not to be retaliated against for exercising such rights.

If submitting your request via email or our online request form, please include “CPRA” in the subject line and detail your request in the body. To submit a verifiable request, you may be asked to provide certain information to help us verify your identity. The information we ask you to provide to initiate a request may differ depending upon whether you are a current or former employee or independent contractor, the type of request, the type, sensitivity and value of the Personal Information that is the subject of the request, and the risk of harm to you that may occur as a result of unauthorized access or deletion, among other factors. 

    You may designate an authorized agent to make a request on your behalf by providing the agent with signed written permission to do so.

    Retention of Your Personal Information

    We will retain the personal information, including sensitive personal information, described above as long as necessary to fulfill the purpose for which it was collected, or as required by applicable laws or regulation.

    Additional Disclosures

    Your Personal Information is not sold or shared (as such terms are defined under the CPRA) by Impossible Foods, and Impossible does not have actual knowledge that it sells or shares the personal information of California residents under 16 years of age.
